Kris Aquino’s theft complaint vs. Nicko Falcis junked by Manila prosecutor

The Manila Prosecutor’s Office has junked Kris Aquino’s theft complaint against her former business manager Nicko Falcis due to “lack of probable cause.”

According to a report by Pep, the resolution signed by Manila Assistant City Prosecutor Geoffrey H. Llarena stated that no qualified theft has been committed as the credit card used by Nicko was named after him.

The resolution stated: “Given the foregoing, the use by respondent of the credit card for his personal expenses (even supposedly in violation of the personal agreement or arrangement between complainant and respondent) does not make him liable for qualified theft.

“He is only liable to pay the bank for the transactions he incurred using the credit card.

“Also, the fact that it is complainant who pays for the credit card does not affect the authority of respondent to make transactions using the same insofar as the bank is concerned and notwithstanding any private arrangement between parties or limitations of authority imposed by complainant for the use thereof.”

Last 2018, Kris filed theft complaints against Nicko in seven cities such as Manila, Pasig, San Juan, Mandaluyong, Makati, Taguig, and Quezon City.

Kris complaint has earlier been dismissed in Makati and Pasig while she withdrew her complaints against Nicko in Mandaluyong and San Juan.
